Interpretation

Application refers to the mobile application used by bidders to participate in auctions listed on the Gavel Platform. Also called “Gavel” or “Gavel by Segistics.”

Bidding and Auction Process

Our Site acts only as a platform for facilitating auctions between bidders and hosts. Our Site does not guarantee the accuracy of auction listings, or the conduct of bidders and hosts. We further do not guarantee the outcome of auctions or the availability of listed items, their quality, or authenticity. Bidders participate in auctions understanding that there are inherent risks associated with online bidding, including but not limited to technical issues or inaccuracies in auction listings by the auction hosts. We endeavor to provide a robust and secure Application platform for bidding but cannot guarantee the absence of all potential issues that other third-parties and unrelated auction hosts may bring.

We may share personal data collected from users with third parties. This may include, but is not limited to, sharing information with marketing companies, advertisers, or data brokers. The user and/or bidder assumes all responsibility or liability for the actions, products, and content of all these auction hosts and any other third parties. We are not responsible for any loss or the condition of, or injury or damage to a shipped physical product that you purchased through an auction house on our Site. Any such responsibility or liability lies with other third parties. While we do not handle the shipping of any physical products directly and cannot control the aspects of this process, we are committed to working with auction hosts to address any issues related to the loss, condition, injury or damage upon your written request.

Geographic Restrictions Disclaimer

The App and any relevant services/product are controlled and offered by us from Missouri. We make no representations that the App is appropriate or available for use in other locations. Those who access or use the App from other jurisdictions do so at their own volition and are responsible for compliance with local law.
